1. Scope and Incorporation

1.1 This Limited Warranty, Return & Refund Policy ("Policy") applies to eligible Torqon-branded air compressor packages and related Products sold by Torqon Air Inc under an applicable quotation, order acknowledgment, or invoice. It is incorporated into the Torqon Terms and Conditions of Sale and Website Use.

1.2 This Policy states the complete warranty and return obligations of Torqon unless an authorized Torqon representative signs a written Order Document that expressly provides different coverage for a specific Product.

1.3 Warranty and return rights are subject to full payment of the applicable invoice. A payment dispute or unpaid balance may suspend processing but does not eliminate non-waivable consumer rights.

2. Who and What Is Covered

2.1 The warranty extends to the original purchaser of a new eligible Product from Torqon for use at the original installation location. It is non-transferable unless Torqon approves a transfer in writing. Mandatory rights of a subsequent consumer owner, if any, are not waived.

2.2 Standard coverage applies only to defects in material or workmanship that existed when the covered component left Torqon or its manufacturing source and that become apparent during normal, intended use within the applicable warranty period.

2.3 Used, refurbished, demonstration, clearance, and "as-is" Products carry only the warranty expressly stated on the applicable quotation or invoice. Third-party products are governed by Section 12.

3. Warranty Start Date and Duration

3.1 A documented "Start-Up Date" is the date the compressor is first properly commissioned and placed in service, as shown by a complete start-up report. The "Shipment Date" is the date the Product is tendered to the outbound carrier or made available for pickup.

3.2 Unless a signed Order Document states otherwise, coverage expires at the earlier of the two limits shown below. If no acceptable start-up report is available, Torqon may calculate coverage from the Shipment Date.

Parts only; labor and all related costs excluded

* Optional Extended Coverage is not automatic. It applies only when separately purchased, paid in full, and expressly identified as a line item or certificate in the Order Documents. For avoidance of doubt, Extended Coverage does not make the entire compressor package a five-year warranty. "Major Components" are defined exclusively as: (a) separator tank; (b) cooler; (c) controller; (d) main motor; and (e) variable frequency drive or VFD, if the Product is so equipped.

3.3 During the first twelve (12) months, Airend is also part of the Entire Package coverage. After the Entire Package period expires, Standard coverage continues only for the Airend through its applicable five-year limit. Under valid Extended Coverage, only the Airend and Major Components continue through their applicable five-year limit.

LIMITED WARRANTY - PARTS ONLY - LABOR IS NOT INCLUDED

Standard coverage: five (5) years for the Airend and one (1) year for the Entire Package. Optional paid Extended Coverage: five (5) years for the Airend and the listed Major Components; all other package components remain covered for one (1) year. ALL COVERAGE IS FOR REPLACEMENT OR REPAIR PARTS ONLY. Labor, diagnosis, travel, removal, installation, freight, rigging, downtime, and related costs are excluded unless Torqon expressly agrees otherwise in writing.

4. Definitions of Covered Components

4.1 "Airend" means the factory-installed screw compression element as an integral assembly, including its rotor housing, rotors, and internal bearings or gearing supplied as part of that assembly. It does not include the drive motor, coupling, inlet valve, minimum-pressure valve, hoses, external piping, external seals, sensors, controller, cooler, VFD, or other package components unless separately covered.

4.2 "Entire Package" means factory-installed non-consumable components of the eligible compressor package, subject to all exclusions and limitations in this Policy. It does not include separately sold dryers, tanks, filters, drains, piping, accessories, downstream equipment, installation materials, consumables, or third-party products unless expressly identified as covered.

4.3 "Major Components" are defined exclusively as: (a) separator tank; (b) cooler; (c) controller; (d) main motor; and (e) variable frequency drive or VFD, if the Product is so equipped. Associated wiring, sensors, contactors, fans, hoses, valves, piping, couplings, mounts, and consumables are not Major Components unless Torqon expressly states otherwise.

4.4 "Parts Only" means Torqon's sole warranty obligation is to provide, at Torqon's option, a repaired, new, remanufactured, or functionally equivalent replacement part for a component Torqon confirms is defective and covered. Parts Only never includes labor or the costs listed in Section 6.

5. Torqon's Exclusive Warranty Remedy

5.1 After a valid claim and reasonable opportunity to inspect, Torqon will, at its option: (a) repair the defective covered component; (b) provide a new, remanufactured, or functionally equivalent replacement part; or (c) if repair or replacement is not commercially available, issue a credit or refund not exceeding the net price originally paid to Torqon for the defective component, as required by applicable law.

5.2 The remedy applies only to the defective component, not the entire compressor package. Torqon may require return of the failed part, photographs, electronic logs, oil samples, operating data, or on-site inspection before determining coverage.

5.3 No person may perform work, order a replacement, or incur expense on Torqon's account without prior written authorization. Torqon does not reimburse unauthorized diagnosis, labor, parts, freight, rental, or other charges.

5.4 If a replacement part is provided before the failed part is returned, Torqon may charge a refundable core deposit or require payment authorization. Failure to return the requested failed part within the RMA period permits Torqon to invoice the replacement and close the claim.

6. Costs Not Covered - Labor and Related Expenses

PARTS-ONLY LIMITATION

NO WARRANTY PLAN IN THIS POLICY INCLUDES LABOR. Buyer is solely responsible for troubleshooting, diagnostic time, technician labor, travel, mileage, lodging, overtime, removal, installation, programming, commissioning, crane or rigging, piping, wiring, oil or refrigerant, shop supplies, environmental fees, disposal, freight, insurance, customs, taxes, rental or substitute equipment, loss of production, and downtime, except where Torqon expressly agrees in writing or applicable law requires otherwise.

6.1 Buyer bears shipping risk and cost for failed parts sent for inspection and for replacement parts, unless Torqon issues written prepaid routing instructions or determines that applicable law requires Torqon to pay a specific charge.

6.2 Torqon may charge reasonable inspection, testing, travel, and handling costs if the claimed component is not defective, is not covered, has been damaged after failure, or cannot be evaluated because Buyer did not follow claim instructions.

7. Conditions Required to Maintain Coverage

7.1 Buyer must install, start, operate, and maintain the Product in accordance with all Torqon manuals, labels, specifications, service intervals, and written instructions; use qualified personnel; and comply with applicable codes and safety requirements.

7.2 Buyer must retain proof of purchase, model and serial number, start-up report, maintenance logs, service invoices, lubricant and parts records, controller fault history, and other records reasonably necessary to evaluate a claim. Service intervals are measured by operating hours or calendar time, whichever occurs first.

7.3 Genuine OEM Parts and Torqon-Approved Lubricant.

(a) Commercial Buyers. As a material condition precedent to the Standard Limited Warranty and any Optional Paid Extended Coverage, Buyer shall use only genuine original equipment manufacturer (OEM) maintenance and replacement parts supplied by Torqon and only the lubricant supplied by or expressly specified in writing by Torqon for the applicable Product model, unless Torqon grants prior written approval for a specifically identified substitute before its purchase, installation, or use. This requirement applies, without limitation, to lubricant, oil filters, intake air filters, separator elements, maintenance kits, intake-valve components, cooling-fan components, seals, gaskets, hoses, valves, and other components used in service or maintenance of the Product.

(b) Consumer Transactions. To the extent the Magnuson-Moss Warranty Act or other mandatory consumer law applies, use of an independent service provider, third-party part, or third-party lubricant will not, by itself, void this Limited Warranty. Torqon may, however, deny coverage to the extent a defect, failure, or additional damage was caused by or materially contributed to by an incompatible, contaminated, incorrectly selected, improperly installed, or otherwise nonconforming part, lubricant, fluid, or service.

7.4 Non-Torqon Parts or Lubricants; Prior Written Approval.

A Commercial Buyer wishing to use a lubricant or maintenance part not supplied by Torqon must obtain Torqon's specific prior written approval. The approval request must identify the Product model and serial number and include, as applicable: the proposed manufacturer; brand and product name; part number; batch or lot number; invoice source; technical data sheet; safety data sheet; certificate of analysis or certificate of conformity; base-oil type; ISO viscosity grade; dimensional, material, temperature, pressure, flow, filtration, electrical, and performance data; and all cross-reference information supporting claimed equivalence.

For a proposed filter or separator element, Buyer must also provide available data concerning filtration efficiency, beta ratio, micron rating, rated flow, initial and terminal pressure drop, bypass setting, collapse or burst pressure, temperature rating, seal material, oil carryover, grounding or conductivity, and compatibility with the Product and lubricant. Oil analysis does not, by itself, establish that a third-party part is technically equivalent or suitable. Torqon's silence, receipt of documents, or processing of an order or claim is not approval. Approval applies only to the specifically identified product, part number, batch or lot, Product model, and installation for which it was issued.

7.5 Alternative Lubricant and Part Sampling Requirements

Whenever Torqon has approved the use of a non-Torqon lubricant or a non-Torqon component that may affect lubrication, oil filtration, oil separation, compressor intake, cooling, operating temperature, or Airend operation, Buyer must collect the following samples:

1. A baseline used-oil sample immediately before the substitute lubricant or part is introduced.

2. A follow-up used-oil sample no later than five hundred (500) operating hours or three (3) months after introduction of the substitute, whichever occurs first.

3. An additional used-oil sample immediately before every subsequent lubricant change.

Before first use of a non-Torqon lubricant, Buyer must also provide a sealed unused reference sample from the same batch or lot and the lubricant manufacturer's current technical data sheet, safety data sheet, certificate of analysis, and batch or lot identification.

Each used-oil sample must be taken while the Product is at normal operating temperature, under normal operating load, and with the lubricant circulating. The sample must be drawn from the Torqon-designated sampling port or another live-zone sampling point approved by Torqon. Buyer must flush the sampling valve and dead-leg volume before filling the sample containers. Samples must not be taken from a cold machine, an unflushed valve, the bottom drain, a stagnant reservoir location, or an open container used for draining or transferring lubricant.

Buyer must collect a minimum total volume of two hundred fifty milliliters (250 mL), or any greater quantity required by the laboratory, in clean, dry, laboratory-supplied, tamper-evident containers. At least one sealed duplicate sample must be retained by Buyer for not less than twelve (12) months. Each container must identify the Buyer, Product model, serial number, total machine hours, lubricant hours, lubricant manufacturer and product, viscosity grade, batch or lot number, sample date and time, sampling point, sampler, last service date, replacement-part numbers, make-up lubricant added since the last change, and any alarms or abnormal operating conditions.

The test sample must be delivered to the qualified laboratory within three (3) business days after collection, and the complete laboratory report must be submitted to Torqon within fifteen (15) calendar days after collection. Torqon may require witnessed sampling, a second sample, direct submission by the laboratory, or collection by Torqon or an independent inspector when reasonably necessary to evaluate a warranty claim.

7.6 Qualified Laboratory and Required Oil-Analysis Panel.

Testing required by this Policy must be performed by a testing laboratory accredited to ISO/IEC 17025 by an accreditation body that is a signatory to the International Laboratory Accreditation Cooperation Mutual Recognition Arrangement (ILAC MRA) for testing. The laboratory's current scope of accreditation must expressly include each test method used for the report. A general ISO certificate, an accreditation logo alone, or accreditation that does not cover the applicable method is insufficient.

Unless Torqon approves a technically equivalent method in writing, the required oil-analysis panel must use the current edition of the following methods:

1. Kinematic viscosity at 40°C under ASTM D445.

2. Acid number under ASTM D664.

3. Water content by coulometric Karl Fischer titration under ASTM D6304.

4. Additive elements, wear metals, and contaminants by ICP-AES under ASTM D5185.

5. Lubricant condition, oxidation, additive depletion, contamination, and incorrect-oil screening by FT-IR trend analysis under ASTM E2412.

6. Automatic particle counting under ASTM D7647, with cleanliness also reported using the ISO 4406 coding system.

Torqon may additionally require ferrous-debris quantification under ASTM D8120; direct imaging or wear-particle analysis under ASTM D7596 or ASTM D7690; foaming testing under ASTM D892; water-separability testing under ASTM D1401; air-release testing under ASTM D3427; analytical ferrography; filter-debris analysis; or other reasonable diagnostic testing when an abnormal result, operating condition, or claimed failure warrants further investigation.

The laboratory report must identify the laboratory, accreditation body, accreditation certificate number, applicable accredited scope, sample identification, sample receipt date, test date, test method, result, unit of measurement, reporting limit where applicable, analyst or authorized approver, and whether any test was subcontracted. The report must compare the used sample with the unused reference sample and prior trend data when available and must identify abnormal viscosity, water, acid number, oxidation, additive depletion, mixed or incorrect lubricant, wear metals, contaminant elements, ferrous debris, and particle contamination.

7.7 Minimum Preventive-Maintenance Schedule.

Buyer must complete an initial preventive-maintenance service no later than five hundred (500) total operating hours or three (3) months after the Start-Up Date, whichever occurs first.

Buyer must complete the next preventive-maintenance service no later than three thousand (3,000) total operating hours or twelve (12) months after the Start-Up Date, whichever occurs first. Thereafter, preventive-maintenance service must be completed at intervals not exceeding each additional three thousand (3,000) operating hours or twelve (12) months, whichever occurs first.

At every service required by this Section, Buyer must, at a minimum:

1. Drain and replace the compressor lubricant.

2. Replace the oil filter.

3. Replace the separator element.

4. Replace the intake air filter.

Buyer must also perform every inspection, adjustment, cleaning, tightening, measurement, and additional replacement required by the applicable Product manual. Any shorter interval required by the Product manual, Torqon's severe-service schedule, environmental or operating conditions, an oil-analysis result, or a written Torqon instruction controls. No extension or grace period is valid unless Torqon approves it in writing before the applicable deadline.

7.8 Scheduled Intake-Valve and Cooling-Fan Replacement.

Buyer must replace the intake valve assembly no later than six thousand (6,000) total operating hours or thirty-six (36) months after the Start-Up Date, whichever occurs first. If the applicable Product manual expressly specifies a complete intake-valve overhaul kit instead of replacement of the entire assembly, installation of the complete Torqon-supplied overhaul kit in accordance with the manual will satisfy this requirement.

Buyer must replace the cooling fan assembly, including the fan motor where integral or specified by Torqon, no later than twelve thousand (12,000) total operating hours or forty-eight (48) months after the Start-Up Date, whichever occurs first.

An intake valve or cooling fan must be replaced earlier when required by the Product manual, inspection findings, abnormal noise or vibration, damaged blades, reduced airflow, excessive current, leakage, sticking, operating-temperature history, controller alarms, or a written Torqon instruction. Damage caused by or materially contributed to by failure to complete a required intake-valve or cooling-fan replacement is not covered.

7.9 Maintenance Records; Effect of Noncompliance.

Buyer must maintain complete, legible, and contemporaneous records showing each service date, total operating hours, lubricant hours, work performed, technician or service provider, replacement-part manufacturer and part number, lubricant manufacturer and product, lubricant batch or lot, quantities used, invoices, photographs where reasonably available, controller history, alarm history, oil-analysis reports, and corrective action taken.

Records must be retained for the applicable warranty period plus one (1) additional year and must be provided to Torqon within ten (10) business days after request unless a shorter period is reasonably necessary to preserve evidence. For Commercial Buyers, timely and complete compliance with Sections 7.3 through 7.9 is a condition precedent to Optional Paid Extended Coverage.

Failure to perform or document required maintenance does not expand Torqon's obligations. Torqon may deny a claim to the extent the failure to comply caused or materially contributed to the claimed condition, allowed additional damage to occur, prevented reliable diagnosis, or materially prejudiced Torqon's ability to verify the claim. Nothing in this Section eliminates a non-waivable Consumer right.

7.10 Buyer must operate within rated pressure, temperature, voltage, frequency, phase balance, duty cycle, altitude, ventilation, ambient, and air-quality limits. Buyer must promptly correct alarms, leaks, overheating, vibration, power-quality issues, and other abnormal conditions and must stop operation when continued use could cause additional damage or create a safety hazard.

7.11 The serial plate, controller history, hour meter, safety devices, and identification labels must remain intact and unaltered. Torqon may deny a claim to the extent alteration prevents verification or causes or conceals the failure.

8. Exclusions - What the Warranty Does Not Cover

The Limited Warranty and Extended Coverage do not cover any of the following, except to the extent mandatory law provides otherwise:

  • Normal wear; routine maintenance; adjustments; cleaning; calibration; or performance decline from ordinary use.

  • Consumables and maintenance items, including lubricant, oil, air filters, oil filters, separator elements, belts, flexible hoses, seals, gaskets, O-rings, valve kits, drains, fuses, contactors, batteries, desiccant, refrigerant, fasteners, coatings, and similar scheduled-service items.

  • Freight damage, handling damage, storage damage, corrosion, erosion, rust, scale, freezing, water intrusion, flood, fire, lightning, surge, phase loss, voltage imbalance, harmonic distortion, unstable power, or inadequate electrical protection.

  • Improper sizing, installation, foundation, anchoring, piping, ducting, ventilation, drainage, wiring, rotation, settings, start-up, shutdown, storage, preservation, or site preparation.

  • Misuse, abuse, neglect, accident, impact, foreign-object ingestion, contamination, incompatible fluid, operation outside specifications, excessive cycling, excessive pressure, continued operation after an alarm or failure, or failure to mitigate damage.

  • Unauthorized modification, altered controller logic, bypassed safety devices, nonconforming repair, welding, machining, disassembly, or use of parts or service that causes the claimed damage.

  • Failure to perform, complete, or document any required initial service, periodic service, lubricant change, filter replacement, separator-element replacement, air-filter replacement, inspection, oil analysis, or other maintenance by the applicable operating-hour or calendar deadline.

  • Use or mixing of an unapproved, incompatible, contaminated, incorrectly graded, or nonconforming lubricant, fluid, maintenance part, filter, separator element, seal, hose, valve, or other component, and any failure or damage caused by or materially contributed to by that use or mixing.

  • Failure to replace the intake valve assembly or approved complete overhaul kit at six thousand (6,000) operating hours or thirty-six (36) months, or failure to replace the cooling fan assembly at twelve thousand (12,000) operating hours or forty-eight (48) months, and any resulting or related overheating, inadequate cooling, restricted intake, oil carryover, contamination, pressure instability, Airend damage, motor damage, cooler damage, electrical damage, or other package damage.

  • A claim that cannot be reliably verified because Buyer failed to preserve or provide a required oil sample, unused reference sample, laboratory report, maintenance record, failed part, controller history, or other requested evidence, but only to the extent that the failure materially prejudices Torqon's investigation or determination of coverage.

  • Ambient or process conditions not disclosed to Torqon, including corrosive, dirty, wet, explosive, toxic, high-dust, high-humidity, high-altitude, or temperature-extreme environments.

  • Cosmetic conditions, paint, appearance, normal sound or vibration within specifications, or a condition that does not materially impair intended operation.

  • Separately sold or third-party dryers, tanks, filters, drains, piping, accessories, motors, electrical devices, controls, software, or downstream equipment except to the extent expressly covered.

  • Failure or delay caused by internet, network, cloud, remote-monitoring, third-party software, cybersecurity event, or communications service.

  • Products used for breathing air, medical gas, oxygen service, explosive locations, life support, nuclear, aviation flight, or other critical application without Torqon's prior written approval.

  • Force majeure, theft, vandalism, acts of war or government, and any cause not attributable to a covered defect in material or workmanship.

9. Optional Paid Extended Coverage - Additional Terms

9.1 Extended Coverage is available only when Torqon expressly offers it, Buyer purchases and pays for it, and it appears in the Order Documents. Unless Torqon agrees otherwise in writing after inspection, Extended Coverage must be purchased before shipment. It cannot be purchased after a failure or known condition.

9.2 Extended Coverage under this Policy is intended only for Products purchased and used primarily for commercial or industrial purposes. A separately charged plan for a Product used primarily for personal, family, or household purposes will be offered, if at all, only under a separate consumer-compliant service contract or other legally authorized arrangement. That separate contract will control.

9.3 Extended Coverage does not extend coverage for the remaining Entire Package beyond one (1) year and does not cover consumables, labor, freight, or excluded causes. It extends only the Airend and the Major Components listed in Section 4.3 through the applicable five-year limit.

9.4 Extended Coverage is non-transferable, applies only at the original installation location, and may require a satisfactory start-up report, maintenance documentation, operating records, oil analysis where specified, and inspection. For Commercial Buyers, timely and complete compliance with all requirements of Section 7 is a condition precedent to Optional Paid Extended Coverage.

9.5 The Extended Coverage charge is non-refundable after coverage begins, except where required by law or expressly stated in a separate written contract.

10. How to Make a Warranty Claim

  1. Stop operating the Product if continued use may be unsafe or may cause additional damage. Protect the Product from further loss.

  2. Notify Torqon in writing within thirty (30) calendar days after discovering the condition and before the applicable warranty period expires. Send the notice through the contact method on the invoice or to the Warranty Department at the mailing address shown above.

  3. Provide the Buyer name, invoice or order number, installation address, model, serial number, operating hours, start-up date, detailed symptoms, alarm codes, photographs or video, electrical readings, maintenance records, and other reasonably requested information.

3A. If any lubricant or maintenance part not supplied by Torqon has been used, provide every prior written approval, product and part specification, technical data sheet, safety data sheet, certificate of analysis, certificate of conformity, batch or lot record, purchase invoice, installation record, chain-of-custody record, unused reference-sample identification, used-oil analysis report, and retained sample required by Section 7.

  1. Obtain written claim authorization and, if required, an RMA before removing or shipping a part. An RMA acknowledges receipt and routing only; it is not a determination that the claim is covered.

  2. Allow Torqon or its designee a reasonable opportunity to inspect, test, and diagnose the Product or failed part. Do not dismantle, alter, discard, or destroy evidence unless necessary for safety and documented.

  3. Return any requested failed part within thirty (30) calendar days after the RMA or other stated deadline, properly packaged and shipped to the designated location. Do not ship to the Miami mailing address unless the RMA expressly says to do so.

10.1 Failure to provide timely notice, records, access, or the failed part does not eliminate a non-waivable legal right, but Torqon may deny a claim to the extent the failure prevents verification, increases the loss, or materially prejudices Torqon.

11. Replacement and Repaired Parts

11.1 Torqon may use new, remanufactured, reconditioned, or functionally equivalent parts. A superseding part may differ in appearance or configuration if it provides substantially equivalent function.

11.2 A part repaired or replaced under this Policy is covered for the remainder of the original applicable warranty period or ninety (90) days from shipment of the replacement, whichever is longer, but replacement does not restart or extend the original Product warranty beyond that rule.

11.3 Removed or returned parts become Torqon's property when a no-charge replacement or credit is provided, unless Torqon states otherwise.

12. Third-Party Products and Standalone Parts

12.1 A Product made by a third party and resold by Torqon carries only the third-party manufacturer's transferable warranty, if any, unless the Order Documents expressly state a Torqon warranty. Torqon may facilitate a claim but does not guarantee manufacturer approval or performance.

12.2 Unless a different written warranty is stated, a new standalone Torqon replacement part is warranted for ninety (90) days from Shipment Date against defects in material or workmanship, parts only. Consumables, electrical/electronic parts that have been installed or energized, and parts damaged by misdiagnosis or improper installation are excluded.

13. Geographic Scope and Transfer

13.1 Unless a signed Order Document states otherwise, this Policy applies to Products installed in the United States. Exported Products, remote locations, offshore locations, and locations lacking reasonable access may be subject to different coverage, parts routing, taxes, duties, and service limitations.

13.2 Warranty rights may not be assigned or transferred without Torqon's prior written approval. A relocation must be reported before movement and may require inspection and recommissioning at Buyer's expense.

14. Disclaimer of Other Warranties and Limitation of Liability

COMMERCIAL TRANSACTIONS

EXCEPT FOR THIS EXPRESS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORQON DISCLAIMS ALL OTHER WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, COURSE OF DEALING, USAGE OF TRADE, AND PERFORMANCE. NO WARRANTY EXTENDS BEYOND THE DESCRIPTION IN THIS POLICY.

14.1 For a consumer product to which federal consumer warranty law applies, implied warranties are not disclaimed but, to the extent permitted by law, are limited in duration to the applicable duration of this Limited Warranty. Some States do not allow limitations on how long an implied warranty lasts, so this limitation may not apply.

14.2 To the maximum extent permitted by law, Torqon is not liable for indirect, incidental, special, punitive, exemplary, or consequential damages; lost profit, revenue, production, use, data, or opportunity; downtime; substitute or rental equipment; removal, installation, labor, travel, rigging, freight, energy, spoilage, or third-party back-charges.

14.3 Torqon's total aggregate liability for a warranty, return, or refund claim shall not exceed the net amount paid to Torqon for the specific Product or component giving rise to the claim. These limitations do not apply to liability that law does not permit to be limited or excluded.

14.4 The repair, replacement-part, or limited refund remedy in Section 5 is the exclusive remedy to the maximum extent permitted by law, even if a limitation of damages is separately held unenforceable. If the exclusive remedy fails of its essential purpose, available remedies remain subject to every lawful damage exclusion and cap.

15. Nondefective Return Eligibility

15.1 A Buyer may request return of an eligible nondefective Product within thirty (30) calendar days after delivery as shown by carrier records. Torqon must issue a written RMA before shipment. The RMA expires fifteen (15) calendar days after issuance unless extended in writing.

15.2 To be eligible, the Product must be unused, uninstalled, unenergized, unmodified, undamaged, complete, in the original packaging with all manuals and accessories, and in new, resalable condition. Buyer must provide proof of purchase and comply with routing and packaging instructions.

15.3 Approved nondefective returns are subject to a twenty-five percent (25%) restocking fee. Buyer is also responsible for original outbound freight, return freight, insurance, crating, duties, taxes, missing items, damage, reconditioning, and other direct costs. The restocking fee does not apply when Torqon verifies that it shipped the wrong Product.

15.4 Torqon may refuse a return that does not meet this Section. Issuance of an RMA does not guarantee a refund; final eligibility and deductions are determined after inspection.

16. Non-Returnable and Final-Sale Items

The following are non-returnable and non-refundable unless Torqon shipped the wrong item, the item is defective and a return is the authorized warranty remedy, or law requires otherwise:

  • Custom, special-order, configured, made-to-order, modified, programmed, private-label, or non-stock Products.

  • Products that have been installed, energized, operated, filled with lubricant, connected to piping or electrical service, registered, altered, damaged, or used.

  • Controllers, VFDs, sensors, circuit boards, electrical or electronic parts, and software or licenses once packaging is opened, the item is installed, or a license is activated.

  • Consumables, fluids, lubricants, filters, separator elements, maintenance kits, seals, gaskets, hoses, belts, desiccant, refrigerant, and hazardous materials.

  • Pressure vessels, receivers, and tanks after shipment, except with Torqon's specific written approval.

  • Clearance, discontinued, liquidation, used, refurbished, demonstration, or "as-is" items.

  • Items returned after the authorized period, without an RMA, to an incorrect location, freight collect, or without adequate packaging.

17. Return Shipping, Risk, Inspection, and Unauthorized Returns

17.1 Buyer shall ship approved returns prepaid, insured for full value, properly packaged, and with the RMA visible. Buyer bears risk of loss until the return is received and accepted at the designated location.

17.2 Torqon may deduct the cost of missing items, damage, cleaning, testing, repackaging, reconditioning, storage, or disposal. If the Product is ineligible, Buyer must arrange return shipment within ten (10) business days after notice or Torqon may charge storage and, where lawful, dispose of or liquidate the Product after additional notice.

17.3 Unauthorized or refused deliveries may be rejected, returned at Buyer's expense, or treated as an unauthorized return. Refusing a shipment does not cancel the Order or create a refund right unless Torqon instructed refusal because of confirmed material freight damage.

17.4 The Miami mailing address is not a return facility. Torqon is not responsible for delay, loss, or additional cost caused by shipment to an address not stated in the RMA.

18. Wrong Item, Defective on Arrival, and Shipping Error

18.1 Buyer shall report a wrong item, shortage, or apparent defect existing at delivery within five (5) business days, with photographs and packaging information. Buyer must not install or use a wrong item.

18.2 If Torqon verifies that it shipped the wrong Product or that a new Product was materially defective at delivery, Torqon will provide reasonable return routing and, at its option, correct the shipment, provide a replacement part or Product, or refund the net price of the affected item. No restocking fee applies to a verified Torqon shipping error.

18.3 A defect discovered after the return period is handled under the Limited Warranty and does not create an automatic right to return the entire Product.

19. Freight Damage Procedure

  • Inspect cartons, crates, shock indicators, and Products before signing the carrier receipt. Note specific damage or shortage on the bill of lading; do not write only "subject to inspection."

  • Take clear photographs of all sides, labels, packaging, the Product, and the carrier record while the driver is present when reasonably possible.

  • For severe visible damage, contact Torqon while the carrier is present and refuse only if instructed or if safe receipt and preservation are not reasonably possible.

  • Report visible damage to Torqon within two (2) business days and concealed damage within five (5) business days or the carrier's shorter deadline. Preserve all materials for inspection.

19.1 When risk of loss has passed to Buyer, the freight claim is Buyer's responsibility. Torqon may assist but does not guarantee carrier acceptance, settlement amount, or timing. Delay or failure to document damage may reduce or eliminate carrier recovery.

20. Refund Processing

20.1 After receipt and inspection of an approved return, Torqon will calculate the refund less applicable fees, freight, costs, damage, and amounts owed. Approved refunds are generally initiated within ten (10) business days after inspection, but banks, card networks, lenders, and payment providers may take additional time.

20.2 Refunds are issued to the original payment method or to the financing or leasing provider as required. Original freight, expedited charges, special handling, duties, taxes remitted to authorities, and other nonrecoverable charges are not refundable unless the return results from a verified Torqon error or law requires otherwise.

20.3 A warranty credit or refund will never exceed the net amount actually paid to Torqon for the affected Product or component.

21. Order Cancellation Before Shipment

21.1 Cancellation requires Torqon's written approval. For standard stock Products not yet shipped, Torqon may approve cancellation subject to documented supplier fees, nonrecoverable costs, payment-processing charges permitted by law, and reasonable handling expenses.

21.2 Custom, special-order, configured, programmed, modified, or made-to-order Products are non-cancellable and non-refundable after procurement, engineering, configuration, or production begins. Torqon will refund any unearned balance that applicable law requires after deducting lawful costs and damages.

22. Governing Terms and Contact

22.1 This Policy is governed by the Torqon Terms and Conditions of Sale and Website Use, including Florida governing law, forum, limitation of liability, and Commercial Buyer jury-trial waiver. Mandatory consumer law controls where it cannot be waived.

22.2 To request warranty service or an RMA, use the contact method on the applicable quotation or invoice, or send written correspondence to: Warranty / Returns Department, Torqon Air Compressor, 382 NE 191st St #445592, Miami, FL 33179, USA. Do not ship Products or parts to that mailing address unless written RMA instructions expressly direct shipment there.
